Fewer Than 25% of Americans Have a Will - Makofsky Valente Law Group, P.C.

The statistics are pretty shocking — according to Caring.com’s 2025 Wills and Estate Planning Study, 76% of Americans do not have a will. Are you one of them? Why the reluctance to make a will?
So, what is the main reason people don’t have a will? Procrastination. Over 40% of those who do not have a will reported that they “hadn’t gotten around to it.” Other common reasons that respondents gave for not having a will included believing they didn’t have enough assets to leave anyone, and concerns over cost and complexity in making a will. Perhaps feelings about mortality come into play when creating a will, but we can assure you that the act of creating a will will not hasten death. What it will do it give you a voice after you die and give your loved ones some direction and peace of mind.

Who should have a will?
Do you have a minor child? You should have a will.

What spurs people to make a will?
What would make someone who doesn’t have a will get one? The number one reason that respondents in the Caring.com survey gave was a medical diagnosis or health concern. But really, why would someone want to wait until they are ill and have other things on their mind to start estate planning?  You want to do your estate planning with a clear head and no outside pressures. According to the survey, people often wait for a major life event, such as buying a home, getting married, or having a child, to think about estate planning, but why wait?
