Power of Attorney

A Power of Attorney is a document that allows you to name one or more persons to take care of your financial affairs and to specify which powers that the agent may have. The New York State Statutory Power of Attorney form contains a list of statutory powers for the agent. At Makofsky Valente Law Group, P.C. we often include additional modified language in the Power of Attorney to authorize many powers not included on the statutory form to expedite your day to day financial needs and to allow for gifting by the agent to family members to facilitate tax and/or Medicaid planning in the event such planning is required at a later time.

When an individual becomes incapacitated and requires Medicaid or estate tax planning, the Power of Attorney is an indispensable document that should be included in every estate and disability plan.
