Major Change for New Yorkers With Disabilities
The New York Achieving a Better Life Experience (NY ABLE) program helps New Yorkers with disabilities and their families save money for everyday needs—without losing important government benefits like Medicaid or Social Security.
A NY ABLE account allows eligible individuals to save and invest money tax-free for disability-related expenses such as housing, education, transportation, healthcare, and more.
What’s New in 2026?
Until now, NY ABLE accounts were limited to people whose disability began before age 26. That rule has changed. Starting in 2026, individuals qualify if their disability began before age 46.
This major update opens the door for thousands of New Yorkers who previously did not qualify.
Who Is Eligible?
A person may qualify for a NY ABLE account if their disability began before age 46 and they:
* Receive SSI or Social Security Disability (SSD) benefits, or
* Are legally blind, or
* Have a qualifying disability per the Social Security Administration; or
* Have a qualifying disability diagnosed by a physician that causes severe functional limitations
Why Consider a NY ABLE Account?
NY ABLE accounts offer several key benefits:
* Tax-free savings when used for qualified disability expenses
* No impact on Medicaid, Social Security, or other government benefits
* Flexible investment options
What Can the Money Be Used For?
Funds may be used for many disability-related needs, including housing, education, transportation, assistive technology, healthcare, personal support services, legal fees, and even funeral expenses.
Contribution Limits
In 2026, up to $20,000 per year may be contributed to a NY ABLE account, with a maximum account balance of $520,000.

Is a NY ABLE Account Enough?
For many families, a NY ABLE account is a great planning tool. However, some situations call for additional planning, such as creating a Supplemental (Special) Needs Trust, to fully protect a disabled loved one’s future.
